Alternative Dispute Resolution

Fact 1: If you want your day in Court, a 1 day trial is likely to cost each of you a total of upwards of $30,000 and for each trial day thereafter approximately another $25,000 each.

Fact 2: Of all matters commenced in Court under the Family Law Act, approximately 97% settle without having a judge decide the outcome. By the time it does settle, each party has probably spent between $5,000 and $25,000 anyway.

Fact 3: There are no statistics that tell us how many cases are resolved without being commenced in court. In our experience however, about 70% of all matters where parties are in dispute resolve with the assistance of a legal practitioner or practitioners without commencing Court action. If that is right then it follows that of any given 100 cases, 70 settle without going to Court and of the 30 that don’t settle before Court, 29 (97% of 30) settle before a final hearing.
